This is about the terms & conditions that govern online ordering on our electronic store.
Https://spongean.com is the website and electronic store of Spongean company, which is based at Varnali Kosta 7, Alimos 17455, Attica Greece, with General Electronic Commercial Registry (GEMI) No 00672001000 and Vat No 068663149 (EORI EL068663149), and with [email protected] as the main email address and service telephone +30 210 9425594.
Spongean.com offers the ability of purchasing products under the condition of full acceptance of these terms and conditions which you are invited to study carefully.
1. Product presentation: Titles, photographs, descriptions
The products are presented in the online store using a part or all of the following elements: title, description, features and photos and are sorted into categories so that they can be easily found on our electronic store.
All the above mentioned elements are indicative in order for the visitor to obtain an overview of the characteristics and properties of the product. Please note that the actual products may show variations, such as indicative but not restrictive packaging (e.g. due to its renewal by Spongean) or the shades of the product (e.g. due to the quality of the photo or the performance of the screen)
2. Order: submission, receipt and execution
2.1 Submission of an electronic order
A purchase order of products is submitted to Spongean by completing the billing and shipping information on the order form available in the online store on the “Checkout” page. The submission of an order is equivalent to a statement of knowledge and full and unconditional acceptance by the you, the customer, of all purchase order terms and conditions, as well as other additional terms (shipping, payment, returns, etc.) associated with the order. For your information, the relevant terms are always linked to the footer of our electronic store.
The submission of a purchase order to Spongean is a proposal to purchase the ordered goods and declare acceptance of all charges described in the order. If there is no information or acceptance, you are entitled to a refund of this payment, if any payment has been made.
You must also check your email for our subsequent order confirmation email message and immediately inform the Company (no later than 2 hours from the time of receipt of an electronic notification with the indication of “Thank you for your order”) in writing of any error, otherwise the items mentioned in the order details of this confirmation email message will be applied to the sales agreement.
2.2 Order receipt
The order is not consider received by Spongean until you, the Customer, receive confirmation that its preparation has been initiated, as described below.
The order is considered received by Spongean from the moment you receive, via email again, an update of the order status with the indication “Your order is being processed”.
After receiving the order Spongean confirms the availability of stock of the products of the order and the possibility of delivering it in the context of the time indicated on our website.
Limitations of Liability: In the context of good faith and business ethics, Spongean is not obliged to accept an order and to enter into the sale of products and/or services, which due to a typographical or computerised error occur on the electronic store at an incorrect price, i.e. less than or greater than the applicable for that period. In the event that an order for such an error in the price is found in only part of the ordered products, then the order is valid and executed normally for the other products and is considered not completed for the products in which the error was found, except where the items in the order are relevant, they are to be used as a single whole and act as a unit with each other the Customer declares that the partial fulfillment of the order does not serve his needs or interests, in which case Spongean must cancel the entire order.
2.3 Order completion
The order is considered binding and the sale is deemed to have been prepared and creates claims of the parties (Customer – Spongean) only by sending and receiving the above e-mail with the indication “Order shipped”.
The above message informs you, the Customer, that the products of your order have been delivered to the shipping company, shipment to your address.
3. Order status update
You, the Customer, receive updates on the status of your order electronically via email to the e-mail address entered by you, and, if you are a registered user of spongean.com, on the screen of your computer in the “My account” page.
The status of the order is constantly updated as and when changes occur during the management of your order. You are obligated to check the status of your order and immediately inform Spongean in writing of any error in the order.
You may also be informed about the progress of the order, by sending an e-mail to the Spongean’s main email address, [email protected].
4. Product availability
You are informed of the availability of the products through indications placed on the page of each product or service on the electronic store. Spongean reserves the right to change the availability of its products as it may be affected by its network of suppliers. In the case where a problem of availability is detected in retrospect, Spongean reserves the right not to accept this order and therefore not to prepare the sale. Any payments will be returned to you without undue delay, in the same way that you chose to pay for that order.
5. Order delivery
Pickup: In the event that, while submitting your order, you choose to pick up the products of your order at Spongean offices, you are obligated to pickup your order within five calendar days of receipt of the relevant confirmation order email. If you do not pick up the product within five (5) calendar days of receipt of the confirmation order email, Spongean reserves the right to withdraw from the sale.
Shipping: In the event that the product is shipped to the place chosen by you, the product is delivered to an external partner-carrier and you are informed electronically that this product has been delivered to the carrier. Shipping costs are calculated on the basis of the Customer’s order and shipping address. Any incorrect registration by the Customer and therefore incorrect calculation of shipping costs shall not be borne by Spongean, but by you. Please note that you may choose to transfer by your own means and expenses, however, in this case, the products are transported also at your own risk.
Delivery Time: The delivery time of the products sold is specified in the order according to availability confirmed in the receipt of the order on behalf of Spongean, and according to the delivery times of our carriers which may well vary depending on the country of destination.
Force majeure: Spongean is not responsible for delays in the execution of the order (including delivery) due to cases where it cannot be attributed to its fault or due to force majeure and therefore Spongean is entitled to an extension of the time for its execution. Examples may be strikes, terrorist acts, war, supplier/transportation/production problems, exchange rate fluctuations, government or legislative acts and natural disasters. If such incidents last more than two (2) months, the sales contract may be terminated by any party without compensation. If you consider that you no longer have an interest in the execution of the order, you are entitled to terminate the sales aggreement and Spongean is obligated to refund the price as well as any other amount paid under the sales aggreement.
6. Defective products
In the event of liability of Spongean for a real and agreed defect of the product, are entitled to a choice: a) to require, without charge, th replacement of the product with another, unless such an action is impossible or requires disproportionate costs (b) request a reduction in the price or (c) withdraw from the sale, unless it is a superficial defect. A defect to be agreed, it must be agreed in writing. If you choose to replace the product, Spongean must make a replacement within a reasonable time.
In any case where you find a defect, you have the possibility to contact the online store immediately after delivery on the same day or the next business day in the company’s main email address, [email protected]. If a product is declared defective by you, the Company expressly reserves the prior diagnosis of the product as defective by competent persons.
Limitation of Liability: Spongean does not provide a guarantee or guarantee protection for the suitability of a sold product for any particular purpose.
7. General conditions
Contracts through the e-shop are governed by European and Greek law, in particular by legislation regulating issues relating to e-commerce, distance selling and consumer protection. Similarly, this website has been created and controlled by Spongean in Athens and the Greek legislation will guide the use of the website and its interpretation. If you choose to access the website from another country, you have the responsibility to follow the laws of that country.
Any dispute that arises from the contractual relationship between Spongean and you, the Customer, will be settled at the relevant courts of Athens.
It is underlined that the protection accorded by the provisions of the Law on distance-based agreements, as well as these terms, is applicable to transactions only with natural persons who deal for reasons which do not fall within the scope of their commercial or professional activities.
If any part of the sales aggreement under these terms proves invalid or inapplicable by a court order, the rest of the aggreement will continue to apply. Spongean may enter into an agreement for the assignment of its obligations to an appropriate third party. On the contrary, you are not entitled to assign or transfer your rights or obligations.
All notifications must be made in writing (by hand, by e-mail, fax or first-class mail, which will be deemed delivered 48 hours after posting).
